1. Agreement to these terms

This website is operated by Once Upon A Leaf, LLC ("Once Upon A Leaf," "we," "us," or "our"). By accessing or using onceuponaleaf.net (the "Site"), you agree to these Terms of Use. If you do not agree with them, please do not use the Site.

You must be at least 18 years old to submit a request through the Site.

2. What this website is

The Site is an informational and marketing website. It describes the seasonal leaf removal and yard cleanup services we offer to homeowners in Walton, Barrow and Jackson Counties, Georgia, and it lets you ask us for a quote.

Nothing on the Site is an offer to enter into a contract, a guarantee that we are available on any particular date, or a guarantee that we serve your specific property. We may decline any request, for any lawful reason, including that a property falls outside our service area or outside what our crew and equipment can safely handle.

3. Pricing, estimates and quotes

This section governs the prices shown on the Site. Please read it carefully.

  • Prices shown on the Site are starting estimates based on a typical quarter-acre lot, and are provided for general guidance only.
  • Your actual price depends on factors we can only assess for your property, including lot size, the volume and condition of leaves, the number and type of trees, terrain, access for our equipment, distance, and the time of season.
  • Posted prices may change at any time without notice. A price shown on the Site is not a binding offer, and displaying it does not obligate us to perform work at that price.
  • Submitting the quote form is a request for a quote. It is not a booking, a reservation, or a purchase. It creates no obligation for either of us.
  • A binding agreement is formed only when we provide you a specific written quote for your property and you accept it. Until then, either of us may walk away for any reason.
  • Any quote we give may be conditioned on verifying conditions when we arrive on site. If what we find differs materially from what was described to us, we will tell you and give you the choice of an adjusted price or no work at all before we proceed.

4. Services are governed separately

These Terms of Use govern the website. They do not govern the performance of any actual work. Services we perform are governed by the specific quote, work order, invoice or service agreement between us. Where anything in these Terms of Use conflicts with the terms of that agreement, the service agreement controls with respect to the services.

5. Your submissions

When you submit information through the Site, you confirm that:

  • The information you provide is accurate and complete to the best of your knowledge;
  • You own the property in question, or you are otherwise authorised to request work on it;
  • Any phone number or email address you provide is one you are entitled to use, and you consent to us contacting you at it about your request.

How we handle what you send us is described in our Privacy Policy.

6. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose, or in a way that violates these terms;
  • Submit false, misleading or fraudulent information, or impersonate anyone;
  • Submit requests through automated means, or submit repeated or bulk requests to flood our form;
  • Use the Site to send advertising, solicitations or spam to us;
  • Scrape, harvest, crawl or otherwise systematically extract content or data from the Site, except by well-behaved search engine crawlers;
  • Attempt to interfere with, disrupt or overload the Site or the systems that serve it;
  • Attempt to gain unauthorised access to any part of the Site, or probe or test its security;
  • Reverse engineer, decompile, or attempt to derive the source of any part of the Site beyond what your browser ordinarily receives;
  • Introduce malware or any other harmful code.

7. Intellectual property

The Site and its contents — including the text, photographs, layout, design, graphics and code — are owned by Once Upon A Leaf, LLC or used with permission, and are protected by copyright and other laws. The name "Once Upon A Leaf" and our leaf logo are our trademarks.

You may view the Site and print or download pages for your own personal, non-commercial use in considering our services. You may not otherwise copy, reproduce, republish, distribute, modify or create derivative works from any part of the Site, or use our name or logo, without our prior written permission.

8. Disclaimers

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Content on the Site is general information only. We try to keep it current and accurate, but we do not warrant that it is free of errors or omissions, or that it is complete or up to date. We do not warrant that the Site will be uninterrupted, timely, secure, or free of viruses or other harmful components, or that any defect will be corrected.

This section does not disclaim any warranty regarding the services we actually perform, which are addressed in the applicable service agreement, and nothing here limits any right you cannot lawfully be asked to give up.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW, ONCE UPON A LEAF, LLC AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE — EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

This limitation applies to claims about the website. It does not apply to, and does not limit, our responsibility for the services we perform at your property, which is governed by the applicable service agreement and by law.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. Nothing in these terms excludes liability for fraud, for wilful misconduct, or for anything else that cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold harmless Once Upon A Leaf, LLC and its owners, employees and agents from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of your breach of these terms, your misuse of the Site, or your violation of any law or the rights of a third party.

11. Changes and availability

We may change, suspend or discontinue any part of the Site at any time without notice. We may also revise these terms at any time. Revised terms take effect when posted here, and the "last updated" date at the top will change. Your continued use of the Site after that constitutes acceptance of the revised terms, so please check this page periodically.

We may restrict or block access to the Site by anyone who we reasonably believe is violating these terms.

12. Governing law and venue

These terms and any dispute arising out of them or out of your use of the Site are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any such dispute is the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts.

13. General provisions

Severability. If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and us concerning the Site, and supersede any prior understanding about it.

Assignment. You may not assign your rights under these terms. We may assign ours in connection with a sale or transfer of the business.
